The Website is intended for users who are 18 years of age or older and reside in the United States. By using the Website, you represent and warrant that you meet all eligibility requirements and can form a binding contract with the Company. Use of Storage Services: In addition to these Terms, if you rent a storage unit from us, your rental is governed by a separate Rental Agreement. The Rental Agreement governs all terms related to your use of the storage unit, payment, access, and any related issues. In the event of a conflict between these Terms and the Rental Agreement, the Rental Agreement will take precedence regarding storage services.

2. Changes To The Terms Of Use

We reserve the right to update or modify these Terms at any time without prior notice. Changes are effective upon posting, and your continued use of the Website constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically for any updates.

3. Accessing The Website And Account Security

We may restrict or terminate access to the Website, or any part of it, at any time without notice. You are responsible for ensuring that all information provided to the Website is accurate, current, and complete. Any personal information you provide is subject to our Privacy Policy.

If you create an account or are provided with login credentials, you must keep them confidential and not share them with others. Notify us immediately of any unauthorized access or breach of security. You are responsible for all activities that occur under your account.

Access to your storage unit is provided through a third-party smart lock application. Your use of that application is governed by the third-party provider's own terms of service and privacy policy, and the Company is not liable for any loss or damage arising from your use of, or inability to use, the third-party application. If you store any other sensitive information on our Website, it is your responsibility to ensure its security, and the Company is not liable for any loss or damage resulting from the storage or misuse of such information.

4. Intellectual Property Rights

The Website and its contents are owned by the Company or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may use the Website for personal, non-commercial purposes only. Unauthorized use of any material on the Website may violate copyright, trademark, and other laws.

5. Trademarks

The Company's name, logos, and trademarks may not be used without our prior written permission. All other trademarks appearing on the Website are the property of their respective owners.

In addition to website activity, we reserve the right to access your storage unit for emergencies, legal compliance, or other necessary reasons as outlined in your Rental Agreement. We reserve the right to refuse service to anyone for any reason at any time.

Information on the Website is provided for general purposes only and may not be accurate or complete. We disclaim any liability for reliance on such information.

9. Changes To The Website

We may update or modify the Website's content at any time without notice. We are not obligated to update outdated information.

10. Information About You And Your Visits To The Website

Our collection and use of your information are governed by our Privacy Policy. By using the Website, you consent to such collection and use.

11. Payments

We accept online payments through designated methods. You agree to provide accurate and complete payment information. By completing a reservation or rental through the Website, you authorize Urban Stash to charge your selected payment method for all applicable fees disclosed during the checkout process and any recurring charges authorized under your Rental Agreement.

Payments relating to storage rentals, including any refund and late payment policies, are governed by your Rental Agreement. These Terms govern only your use of the Website.

Fraudulent or unauthorized payment activity is strictly prohibited. We reserve the right to suspend or terminate accounts, cancel transactions, and pursue any legal remedies available to us. We employ security measures and fraud detection techniques to identify and prevent fraudulent transactions.

You may link to our homepage, but not in a way that implies endorsement. Unauthorized framing or linking is prohibited.

13. Links From The Website

The Website may contain links to third-party websites for convenience. We are not responsible for the content or reliability of these sites.

14. Geographic Restrictions

The Website is intended for use within the United States. Access outside the U.S. may not be legal, and users are responsible for compliance with local laws.

15. Notices

You agree that we may provide you with any notices, disclosures, or other communications required by law or relating to your use of the Website, storage services, or your account (collectively, "Notices") electronically, including by email to the email address associated with your account, by posting on the Website, or by any other method reasonably designated by us. All such Notices shall be deemed effective upon transmission or posting. It is your responsibility to ensure that we have your current and accurate email address on file and to regularly review the Website for posted Notices.

16. SMS/Text Messaging Program

Program Description. Urban Stash operates a recurring SMS/text messaging program for customers and prospective customers who provide their mobile number and affirmatively consent to receive text messages from us. We use text messages to support and service your reservation, rental, and account, and, where you have separately opted in, to send you marketing and promotional offers. Messages are sent only to individuals who have provided their prior express consent (or, for marketing messages, prior express written consent) by submitting their mobile number through our reservation or checkout flow, an online form, a written agreement, or by texting us first. Text messages you may receive include:

Reservation and rental confirmations, including unit assignment and move-in details
Access instructions, smart lock or entry credentials, and access-related notifications
Billing, payment, autopay, failed payment, and past-due notices
Account, unit, and facility notices, including maintenance, service disruptions, and emergency or security notifications
Customer support responses and follow-up regarding an inquiry you initiated
Promotional offers, discounts, and news about our services, sent only if you have separately consented to receive marketing messages

Consent. Your consent to receive marketing text messages is not a condition of renting a storage unit or purchasing any goods or services from us. You may continue to reserve and rent from Urban Stash without agreeing to receive marketing text messages. By providing your mobile number, you represent that you are the subscriber or customary user of that number and that you are at least 18 years of age. You agree to notify us if your mobile number changes or is reassigned.

Message Frequency. Message frequency varies. Service and transactional messages are sent based on your account activity and the status of your reservation, rental, or support request. If you have opted in to marketing messages, you will receive no more than five (5) marketing messages per month.

Message and Data Rates. Message and data rates may apply. Any charges for text messages are billed by, and payable to, your mobile service provider, and Urban Stash is not responsible for those charges. Please contact your wireless carrier for details about your text and data plan.

Opt-Out (STOP). You may cancel the SMS program at any time by replying STOP to any text message you receive from us. After you send STOP, we will send you a single message confirming that you have been unsubscribed, and you will not receive further text messages from that program unless you opt in again. You may also opt out by emailing support@urbanstash.co. If you opt out, we may still contact you by email, mail, or other means as described in Section 15 (Notices), including for notices required by law or by your Rental Agreement.

Help (HELP). For help or more information about the SMS program at any time, reply HELP to any text message you receive from us, email support@urbanstash.co, or visit https://urbanstash.co/. Replying HELP will return a message with our contact information and instructions for opting out.

Supported Carriers and Delivery. Carriers are not liable for delayed or undelivered messages. Delivery of text messages is subject to effective transmission by your wireless carrier and is outside our control. We do not guarantee that any message will be delivered, and we are not liable for any loss or damage arising from a delayed, undelivered, or misdirected message.

Privacy. Information you provide in connection with the SMS program is handled in accordance with our Privacy Policy. We do not sell, rent, or share mobile numbers or SMS consent with third parties or affiliates for their own marketing purposes. Mobile numbers may be shared with service providers that help us operate the messaging program solely for that purpose.

17. Disclaimer Of Warranties

The Website is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy, reliability, or availability of the Website or its content.

18. Limitation On Liability

To the fullest extent permitted by law, we are not liable for any damages arising from your use of the Website or its content, including but not limited to direct, indirect, or consequential damages.

19. Indemnification

You agree to indemnify and hold harmless the Company from any claims or liabilities arising from your use of the Website or violation of these Terms.

20. Governing Law And Jurisdiction

These Terms are governed by the laws of the State of New York. Any legal action must be brought in federal or state courts located in New York County, New York. However, we will comply with all applicable local laws in the jurisdictions where our storage services are offered.

21. Waiver And Severability

Failure to enforce any provision of these Terms does not waive our right to enforce it later. If any provision is deemed invalid, the remaining provisions remain in effect.

22. Entire Agreement

These Terms, the Rental Agreement, and our Privacy Policy constitute the entire agreement between you and the Company regarding the Website and storage services, superseding any prior agreements.
